1.  Terms & Conditions 


1. Nature of the Platform & Parties

Intermediary Status: gigm8.com is a platform that facilitates connections. It is not a party to any "Task Contract" between a Buyer and a Tasker.

Independent Contractors: Clearly state that Taskers are independent contractors and not employees or agents of gigm8.com.

User Eligibility: Users must be at least 18 years old to enter into a legally binding contract in NZ.


2. Consumer Protection & Guarantees (CGA & FTA)

Consumer Guarantees Act (CGA): Services must be performed with reasonable care and skill, be fit for purpose, and completed within a reasonable time.

No Contracting Out: You cannot "contract out" of the CGA for personal or household services. Any clause claiming "no refunds" or "no liability" for substandard services is illegal and unenforceable.

Fair Trading Act (FTA): All listings must be accurate and not misleading. Prohibit "bait advertising" or false claims about a Tasker's skills or a job's scope.


3. Payments, Fees & Cancellations

Service Fees: Explicitly state the fees gigm8.com charges for using the platform.

NZ Currency: All transactions should ideally be in NZD, with clear disclosure of any GST included or excluded.

Payment Holding: Use a secure third-party payment provider (like Stripe or Escrow) and outline when funds are released to the Tasker.

Cancellations: Define the "cancellation window" and any associated fees, ensuring they are fair and not "unconscionable".


4. User Conduct & Safety

Prohibited Tasks: Strictly ban illegal acts, adult services, and high-risk tasks requiring specific NZ licensing (e.g., licensed electrical or plumbing work) unless the user provides proof of license.

Safety Responsibility: While the platform connects users, the parties are responsible for their own safety and for checking the other party's identity or credentials.

Non-Circumvention: Prohibit users from taking transactions "off-platform" to avoid service fees.


5. Privacy & Data (Privacy Act 2020)

Privacy Principles: Your T&C (or linked Privacy Policy) must explain how, why, and where you collect personal information.

Access & Correction: Users have a legal right to request a copy of their data and ask for it to be corrected.

Breach Notification: You are legally required to notify the Office of the Privacy Commissioner of any "notifiable privacy breach" that causes serious harm.


6. Dispute Resolution

User-to-User Disputes: Encourage users to resolve issues directly. State that gigm8.com may (but is not obligated to) provide a mediation service.

Disputes Tribunal: Remind users that for larger disputes, the NZ Disputes Tribunal is the standard venue for claims up to $30,000.

Governing Law: The agreement must be governed by the laws of New Zealand.
